1. Agreement to Terms
Welcome to Trickl. These Terms of Service ("Terms") govern your access to and use of the Trickl mobile application, website, and services (collectively, the "Service") provided by Trickl Technologies Inc. ("Trickl," "we," "our," or "us").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
2. Eligibility
To use Trickl, you must:
- Be at least 18 years old
- Be a legal resident of the United States
- Have a valid bank account at a supported financial institution
- Provide accurate and complete registration information
- Not be prohibited from using financial services under applicable law
3. Account Registration
When you create an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account credentials.
4. Service Description
Trickl provides the following services:
- Round-Up Savings: Automatically round up your purchases to the nearest dollar and save the difference
- Subscription Management: Track and manage your recurring subscriptions
- Digital Wallet: Store funds for subscription payments
- Automatic Payments: Pay subscriptions automatically from your Trickl wallet
- Bank Account Linking: Connect your bank accounts to enable round-ups and funding
5. Financial Services
Trickl partners with licensed financial service providers to offer our services. By using Trickl, you authorize us to:
- Access your bank account information through our banking partners
- Initiate transfers from your linked bank account to fund your Trickl wallet
- Process payments to subscription providers on your behalf
- Store funds in your Trickl wallet
Important: Trickl is not a bank. Banking services are provided by our partner financial institutions. Funds held in your Trickl wallet may be eligible for FDIC insurance through our banking partners, subject to applicable limits and conditions.
6. Fees
Trickl is free to download and use. We may charge fees for certain premium features or services. Any applicable fees will be clearly disclosed before you incur them.
We reserve the right to change our fee structure at any time. We will provide reasonable notice of any fee changes that may affect you.
7. User Responsibilities
When using Trickl, you agree to:
- Use the Service only for lawful purposes
- Maintain sufficient funds in your linked bank account for round-ups and transfers
- Keep your account information accurate and up-to-date
- Not use the Service to engage in fraudulent or illegal activity
- Not attempt to circumvent any security features of the Service
- Not interfere with or disrupt the Service or servers
8. Intellectual Property
The Service and its original content, features, and functionality are owned by Maltivas Corp. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
9. Termination
You may close your account at any time by contacting us or using the account closure feature in the app. Upon closure, any remaining funds in your Trickl wallet will be transferred back to your linked bank account.
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or as required by law. We will provide notice of termination unless prohibited by law or in cases of fraud.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure. We are not responsible for any delays or failures in the Service caused by factors beyond our reasonable control.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRICKL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability for any claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100.
12. Dispute Resolution
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Delaware, and judgment on the award may be entered in any court of competent jurisdiction.
You agree to waive your right to participate in class action lawsuits or class-wide arbitration against Trickl.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and/or sending you an email. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
